Terms of Service

SupaFAX is a mobile application that allows you to send faxes from your iPhone or Android device for a flat fee of $1.99 per fax. No subscription is required.

By downloading, installing, or using SupaFAX, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

You must be at least 13 years old to use SupaFAX. By using the app, you represent that you meet this age requirement.

You are responsible for ensuring that your use of SupaFAX complies with all laws and regulations applicable in your jurisdiction.

Per-fax pricing: Each fax costs $1.99, charged at the time you initiate the send. There are no subscriptions, monthly fees, or auto-renewals.

Billing: Payments are processed through your App Store (iOS) or Google Play (Android) account. Your purchase is subject to that platform's payment terms.

Refunds: If your fax fails to deliver and no retry succeeds, contact us at kausi.me@gmail.com within 7 days and we will issue a refund. We do not refund successfully delivered faxes. Refunds for in-app purchases may also be requested through Apple or Google directly.

Pricing changes: We reserve the right to change the per-fax price with reasonable notice. Price changes will not affect faxes already sent.

You may use SupaFAX only for lawful purposes and in accordance with these Terms. You agree not to use SupaFAX to:

• Send unsolicited bulk faxes (spam) or violate the Telephone Consumer Protection Act (TCPA) or equivalent laws

• Transmit content that is unlawful, harmful, defamatory, obscene, or infringing on the rights of others

• Impersonate any person or entity or misrepresent your affiliation

• Attempt to reverse-engineer, circumvent, or disrupt the service

• Use the service in a way that could overload, damage, or impair our infrastructure

We reserve the right to suspend or terminate access to any user who violates these terms.

We make reasonable efforts to deliver every fax successfully and promptly. However, fax delivery depends on factors outside our control, including the availability of the recipient's fax machine and the performance of our carrier partner (Telnyx).

SupaFAX does not guarantee delivery times or 100% uptime. We are not liable for delays or failures caused by third-party networks or infrastructure.

We may perform maintenance that temporarily interrupts the service. We will endeavor to minimize disruption.

SupaFAX uses HIPAA-grade transmission standards. However, we are not a HIPAA Business Associate (BA) and do not sign Business Associate Agreements. If you require a BAA for your use case, you should not use SupaFAX for Protected Health Information (PHI).

You are solely responsible for ensuring your use of SupaFAX complies with any privacy or data-handling obligations applicable to the documents you transmit.

SupaFAX and all related content, features, and functionality (including but not limited to the app design, graphics, and code) are owned by us and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of SupaFAX without our prior written consent.

SupaFAX is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, SupaFAX and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

Our total liability to you for any claim arising from these Terms or your use of SupaFAX shall not exceed the amount you paid us in the 30 days preceding the claim.

We may update these Terms of Service from time to time. We will notify you of material changes via the app or by updating the "Last updated" date below. Continued use of SupaFAX after changes become effective constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
